NOTICE is hereby given in accordance with Chapter 551, Texas Government Code, that a SPECIAL MEETING of the Commissioners Court will be held in the Commissioners Courtroom of the Administration Building, 100 E. Cano, 1st floor, Edinburg, Hidalgo County, Texas. Discussion and possible action relating to the following business will be transacted:

             
1.   Roll Call

Judge Richard Cortez called the meeting to order at 10:01 a.m.
All Commissioners were present for roll call.
             
2.   Pledge of Allegiance

The court was led by United States Marine Veteran, Daniel Flores, the entire court recited the Pledge of Allegiance.
             
3.   Prayer

Opening prayer was offered by Julia Sullivan.
             
4.   Approval of Consent Agenda

The court moved to approve the consent agenda with the exception of item 8. A. and 8. B. 1 and 2 to be pulled for further discussion.

On motion by BOARD MEMBER PCT. 2, EDUARDO “EDDIE” CANTU, seconded by BOARD MEMBER PCT. 4, ELLIE TORRES, the Board made a UNANIMOUS vote of approval.

5.   Tax Office - Paul Villarreal:
             
A.   AI-71763    1. Submission of 2019 effective and rollback tax rates.
2. Discussion of 2019 planning calendar.
3. Discussion of 2019 tax rates.
4. Record vote on proposed 2019 tax rate and schedule two (2) public hearings if proposed tax rate exceeds the lower of the effective or rollback rates.

The effective tax rate for the County is at 0.5788.  The tax office is recommending the Court approve for an increase to .58; however this would require 2 public hearings for public comments.  Commissioner Eduardo "Eddie" Cantu proposes the rate stay at the effective rate.  If approved the rate can be lowered but can not be raised higher than the .5788 rate.  The projected rate would be .575.

Commissioner Eduardo "Eddie" Cantu motions to keep the tax rate at the effective rate of .5788.

A.   Presentation for discussion of the following:
1) Update on ongoing county owned building construction, relocation and/or renovation repair projects

Commissioner David Fuentes informs the court of the Ground Breaking for the substation for the Tax Office, Health and Human Services, and Planning Department. It will be at the Precinct 1 office location. There is also a portable building that will be the temporary office till the building is finished. The portable office will be open effective tomorrow 08-21-19.

Commissioner Eduardo "Eddie" Cantu joined the meeting.

2) Emergency situations occurring since last agenda meeting

Valde Guerra informed the Court of a chemical spill on the roof of the Administration building. There was an order that spread to the inside of the building so the building was temporarily evacuated while the building was vented out.

Consideration and approval of Imposition of Optional Fees for Calendar Year 2020 (option A-retain the same fees as 2019) in accordance with Transportation Code §502.401, §502.402, and §502.403.

Sergio Cruz recommends to impose the same fee from this year of $10.00 Road and Bridge fee and a $10.00 Transportation fee.

13.   Open Forum

Fern McClaughtery expresses her concerns with the expenditures of the County. She is please with the 1 cent decrease in taxes but reminds the Court to remain mindful of the spending that leads to the tax increase.

Joe Rodriguez has concerns with Commissioners refraining from voting due to family connections to the items. Still has concerns with bar ditches and proactive clean up before disasters.

Jerusalem Flores expressed concerns with the property taxes in the county.

Anna Gonzalez, from Arise, stated her colonia was founded over 25 years ago and it still has no street lighting. She would like for the county to provide more infrastructure for lighting. She is asking for 500,000.00, which is only 0.23 percent of the available funding, to be made available for lighting in the colonias. She is asking for at least 2 subdivisions in each precinct be provided with lights per year.

Chairman Judge Richard Cortez adjourned the meeting.

On motion by COMMISSIONER PCT. 1, DAVID FUENTES, seconded by COMMISSIONER PCT. 4, ELLIE TORRES, the Court made a UNANIMOUS vote of approval.

Vote: 5 - 0 – Unanimously
