BE IT REMEMBERED, that on this 1st day of September A.D., 2020, there was begun and held a SPECIAL MEETING of the Honorable Commissioners’ Court of Hidalgo County, Texas, wherein the following members thereof were present, to-wit:

NOTICE is hereby given in accordance with Chapter 551, Texas Government Code, that a SPECIAL MEETING of the Commissioners Court will be held in the Commissioners Courtroom of the Administration Building, 100 E. Cano, 1st floor, Edinburg, Hidalgo County, Texas. Discussion and possible action relating to the following business will be transacted:

Judge Cortez called the meeting to order at 9:48 A.M.

All members of the board were present during the roll call.
             
2.   Prayer (Audio Reference 02m:02s)

Raul Sesin offered the prayer.
             
3.   Open Forum (Audio Reference 03m:06s)

There were no Open Forum participants.
             
4.   Approval of Consent Agenda (Audio Reference 03m:45s)

Raul Sesin requested to pull Consent Agenda item 2.A.2 to correct the stated amount.

The court proceeded to approve the remainder of the Consent Agenda.

On motion by COMMISSIONER PCT. 2, EDUARDO “EDDIE” CANTU, seconded by COMMISSIONER PCT. 1, DAVID FUENTES, the Court made a UNANIMOUS vote of approval of the Consent Agenda, with the exception of Consent Agenda item 2.A.2

5.   General Operations:
             
A.   AI -77117    Requesting approval to declare surplus for approximately 491,137 Cubic Yards of Fill Dirt located at "Located between Texas Blvd. and Pomelo Rd. on the north side of Military Hwy. U.S. 281 in as much as an attempt was made for the sale and removal through RFB No.: HCDD1-20-048-08-26, advertised for (2) weeks, and No Bids were received. (Audio Reference 05m:04s)

On motion by COMMISSIONER PCT. 1, DAVID FUENTES, seconded by COMMISSIONER PCT. 2, EDUARDO “EDDIE” CANTU, the Court made a UNANIMOUS vote of approval on item 5.A.

B.   AI -77139    1.  Requesting approval of Supplemental Agreement No. 1 to the Professional Engineering Services Contract (C-HCDD1-19-041-05-21), with Quintanilla, Headley, & Associates, Inc., for the project: "J-08 Drain -2018 Bond Referendum Project #15-B", to reflect a Revised Exhibit "D"-Work Schedule, with an extended termination date of June 30, 2021 (subject to Legal review and compliance with HB1295).

On motion by COMMISSIONER PCT. 4, ELLIE TORRES, seconded by COMMISSIONER PCT. 1, DAVID FUENTES, the Court made a UNANIMOUS vote of approval on items 6.B.1 & 6.B.2.

C.   AI -77155    Requesting acceptance and approval of Work Authorization No. 1 for the provision of Construction Materials Testing Services for:  "Old La Blanca & Mile 10 N. -2018 Bond Referendum Project #28" in the amount of $ 25,759.21 , through awarded Contract No. C-HCDD1-20-019-03-10, with Raba Kistner, Inc., for "Hidalgo County Drainage District No. 1 -On Call Professional Construction Materials Testing Services" (Subject to Legal Review). 8.   Closed Session:

Commissioner Torres stepped away from the meeting.

The court proceeded into Closed Session at 9:57 A.M..

Legal Counselor, Ivan Perez, recommended approval for the administration to proceed as directed, as discussed in Closed Session, in regards to the real estate matter.

On motion by COMMISSIONER PCT. 1, DAVID FUENTES, seconded by COMMISSIONER PCT. 2, EDUARDO “EDDIE” CANTU, the Court made a UNANIMOUS vote of approval, as recommended by Legal Counselor, Ivan Perez, on item 9.A.

Vote: 5 - 0 – Unanimously
             
B.   Possible Action on Pending and/or Potential Litigation

No action was taken on item 9.B.

Judge Cortez adjourned the meeting at 10:03 A.M.
